MOBILE PRIVACY POLICY

1. Policy scope and purpose, changes to the policy

Thank you for using our mobile application Lucky Day App (the “App”) via your mobile handset. This App is optimized for your handset screen and is different than our website accessible by your computer. As such, the manner in which we collect, store, manage, share and use the data collected from the App may be different that that collected from our website at www.luckydayapp.com (the “Site”).

Lucky Day App, LLC a Nevada limited liability company (the “Company”) respects the privacy of its users and recognizes the importance of providing a secure environment for them. We know that you care how information about you is used and shared. This privacy policy describes how we collect, store, and use the information you provide to us through your use of the App. You should carefully review this privacy policy before using the App . This privacy policy applies only to information collected through this App and not to any information collected from us or through us through other platforms, including the Site or Facebook. You should carefully review this privacy policy before using this App. By using this App or any of the features contained therein , you signify your assent to this privacy policy. If you do not agree to this privacy policy, please do not use this Mobile Service or provide any information This privacy policy may change from time to time, so please check back periodically to ensure that you are aware of any changes. Your continued use of the App will signify your acceptance of those changes.

2. What information is collected?

A. Demographic Information. For some activities, your handset may transmit certain geographic information or information regarding you, your mobile device or location to the Company. The Company may use that information to generate aggregate statistics about our user community and may provide that information to advertisers and other parties with whom we have a business relationship. In addition, the Company may use any such information for security, system integrity (the prevention of hacking, cheating and other improper or unlawful activities), or enforcement purposes.

When you use this App, we may, at our option, automatically collect and store the following types of non-personally identifiable information received from you: (i) click-through statistics; (ii) behavioral usage of the App (iii) your country; (iv) the type of mobile operating system you are using; (v) the date and time you access this App and the duration of your visit; (vi) mobile page views; and (vii) the type of handset device and mobile operating system you are using (e.g. Android, iPhone, etc…). The Company only uses this data in aggregate form, for statistical purposes, and not in a manner that would give the Company sufficient information to identify you personally. Automatically collected information of that kind typically provides us with a greater understanding regarding the use of this App, including which features are the most popular with our visitors, what types of content, games, offers and products our users are interested in, where they are generally located and what are their general mobile usage behavioral patterns. That information also allows us to determine if this App is working properly, make changes to the App that allows users to have better experiences on the App, and improve the App, our offers and promotional content so that they are more relevant to our users. We collect that information and track it for statistical purposes; we do not use it to identify or to market to a particular user. This information may be shared with advertisers, fulfillment partners and other third parties on an aggregated basis, but it does not include the Personal Information of individual users (defined below).

(b) Personal Information.

NOTE: This App is not intended for children. We do not knowingly collect, use or disclose Personal Information about visitors under 13 years of age. For more information please see Section 9, “What About Children,” below.

The Company may also, at its option, collect personally identifiable information from you when you use some of the features on the App. The Company stores your Personal Information on its servers and/or may share and store such Personal Information with third party subcontractors, affiliates of the Company, retailers, fulfillment partners and marketing partners.

“Personal Information” may include, without limitation: your first and last name, gender, your email address, your cell phone number, date of birth, PayPal or Venmo email address and account name (for sending payments), geographic location, game feature uses and preferences, and other demographic information that could help identify you. We may obtain some Personal Information through your Facebook account if you register through your Facebook credentials. If you have set up an account that is password protected in order to use any feature on the App or for any other purpose for which a password is needed, that password is also part of your Personal Information. It may be possible to use portions of this App without providing any Personal Information, but it may be necessary to provide Personal Information to utilize all features of this App, including, without limitation, receiving payments if you win.

3. How secure is your Personal Information?

The Company has taken reasonable steps to provide that all Personal Information collected by us through the App will remain secure. For example, if our App provides an opportunity for users to purchase virtual goods, we will use industry-standard, SSL (secure sockets layer) encryption through third party providers like PayPal or Venmo for making and receiving payment. In addition, we take reasonable steps to require that these third parties to whom we transfer any data will provide sufficient protection of Personal Information received from us.

However, no Internet, mobile or e-mail transmission is ever fully secure or error free. In particular, e-mail or SMS message sent or any other information or data sent to or from our servers over the public Internet may not be secure. Therefore, users should therefore take special care in deciding what information they send to Company through an Internet connection or mobile network.

You can help us to protect your Personal Information by: (i) ensuring your handset device is locked, (ii) not sharing any password or log-in data with others; and (iii) changing your password frequently. Company is not responsible for any breaches of a user’s profile and access to their Personal Information, which is attributed to lost or stolen user names and passwords. In the event of an inadvertent disclosure of a user’s user name and password, users are advised to change their password as soon as they become aware of such disclosure.

4. How do we use your Personal Information?

The Personal Information you provide to the Company will allow us to do the following: (i) fulfill your orders for virtual goods and services; (ii) award you any prizes you may have won; (iii) alert you of new products or services, features, updates and enhancements; (iv) identify you by your when we publish your wins on the in-App leader board; (v) publish your location to other App users when you win; (vi) handle your customer service or technical support questions or issues; (vi) personalize your experience while using our App; (vi) deliver the type of content and product offerings in which we think you will be most interested; and (viii) notify you of upgrade opportunities, in-app purchases, contests, promotions, gaming, drawings or special events and offers. We may enhance or merge the Personal Information collected on the App with data provided to us by others or aggregated from other Company properties.

We may share your Personal Information among our marketing partners. They may use your Personal Information to offer you products and services that we think may be of interest to you. We may also use your Personal Information for internal marketing, profiling or demographic purposes, so we can adapt our products and services, the better to suit your anticipated needs. Finally, will publish your name and winnings on our leaderboard.

5. Does Company disclose Personal Information it collects to outside parties?

In addition to other disclosures set forth in Section 4 above, the Company may need to disclose items of your Personal Information to third-party vendors to fulfill product orders or prizes, to process mailings, or to process, analyze, or store data on the Company’s behalf without requiring further notice or consent from you. Those third parties are not authorized by the Company to use or disclose your Personal Information for any purpose other than for use in connection with the provision of services designated by us or the delivery and processing of transactions or services. We will take reasonable measures to have those third parties maintain the confidentiality, security, and integrity of the Personal Information they obtain from us.

We reserve the right to disclose your Personal Information as required or permitted by law. For example, we may disclose it to respond to a subpoena, court order or other legal process, or in special cases when we have reason to believe that disclosing Personal Information is necessary to identify, contact, or bring legal action against you if we believe that you may be violating your agreements with us (including, without limitation, any applicable terms of use), or may be causing injury to, or interference with, the Company, any other user of this App or any service, the general public or other third parties. We may also disclose your Personal Inormation to protect the Company from legal liability.

You may also receive information from third parties. By using the App, the Company and those third parties may use your Personal Information to contact you. However, please be aware that Company cannot control the activities of third parties to whom we provide data; we therefore cannot guarantee that they will adhere to similar privacy and security procedures as Company. You may opt out of receiving third party communications pursuant to Sections 8 and 12 of this Privacy Policy.

6. The transfer of Personal Information.

The Personal Information you provide to Company may be transferred as an asset in connection a merger or sale involving all or part of Company or as part of a corporate reorganization, stock sale or other change of control. As part of its business operations, the Company may transfer Personal Information to servers or recipients in countries that do not provide the same level of legal data protection as the country from which you access our App. By using the App, you consent to the transfer of Personal Information and to the processing by the Company of that Personal Information.

7. Who is collecting your information?

When you are asked for information while on this App, you are sharing that information with Company, and its various affiliates and marketing partners, unless specifically stated otherwise. As a result of that sharing, you may receive communications from any of those affiliates and marketing partners. In addition, some services offered by the Company through this App are provided in conjunction with third parties with which the Company has a business relationship. If your Personal Information is being collected by an entity other than the Company, you will be so notified at the time that the process for the collection of that Personal Information is initiated. If you do not want to have your Personal Information so shared, please do not elect to use the service, the App or other platform from which that Personal Information is collected.

8. How can you manage your Personal Information?

At the time you provide personal information, Company will give you the option of declining any future offers or information about new products, promotions, or services. In addition, many of the messages that Company may send you, such as SMS alerts, may be disabled by you within your mobile device preference settings on the App. You may also be given the opportunity to “opt out” of certain features or functions through the App through the App’s settings. Note, however, that if you opt out of certain communications, you may not have full access to all the App’s features.

9. What about Children?

This App is designed by the Company and intended to be considered for use of adults who are of the age of majority in their state of jurisdiction and is not intended for use by children. 12. California Privacy Rights.

Our App may provide advertising or other links to various third party mobile applications in the Apple App Store or Google Play, which are provided as an accommodation to you. However, even if a third-party affiliation exists between our App and the other applications, we do not exercise authority over these other mobile applications, each of which maintains independent privacy and data collection policies and procedures. We do not assume responsibility or liability for these independent methods or actions and are not responsible for the independent policies or procedures of these other mobile application publishers or third party platforms. Similarly, we cannot take responsibility for the privacy initiatives or the content of such mobile application publishers or third party platforms.
